Terms of Service · Version 1.0 · Last updated 15 October 2026 · South Africa
1. The company and this agreement
These Terms of Service (“Terms”) govern your use of SPARK! (“Spark”, “we”, “us” or “our”), a social-discovery platform operated by NOA AFRICA (PTY) LTD, South African company registration number 2026/794059/07, trading as SPARK!. Our address for legal correspondence is 55 Carmen Place, Sandown, Sandton, South Africa. Contact us at sparkadminn@gmail.com or +27 69 929 1696.
By creating or using an account, you agree to these Terms and acknowledge our Privacy Policy. Please also read the community standards in section 7 below, which form part of these Terms. You must not use Spark if you do not accept the Terms. Nothing here removes a right or remedy that cannot lawfully be excluded.
2. Eligibility and verification
You must be at least 18 years old, legally able to agree to these Terms and provide truthful, current account information. Spark focuses on South Africa, initially Johannesburg. International visitors may register, but at present a verified account requires a South African identity card or South African driving licence. People without an accepted document may not be able to access the verified parts of Spark.
Verification requires separate images of the front and back of an accepted document and a selfie used only for verification, not as a public profile photo. Spark currently reviews submissions manually. Verification does not amount to a criminal-history check, an endorsement or a guarantee that someone is safe or genuine in every respect. You must not submit forged documents, use someone else's identity or circumvent verification requirements.
3. Accounts and security
Maintain the security of your password and account. You may not transfer, sell or share an account, pretend to be another person or create accounts to avoid a restriction. Inform us promptly if you suspect unauthorised account activity. We may take proportionate action to protect accounts, including requiring clarification or restricting access while we investigate suspected misuse.
4. What Spark provides
Spark allows eligible adults to discover, create and request to join social outings, communicate about accepted outings and report concerns. Unless we expressly say otherwise, outings are organised by independent users, hosts, venues or businesses—not by NOA AFRICA (PTY) LTD. Spark is not automatically the host, supervisor, transport provider, insurer or organiser of a listing merely because it appears on the platform.
Spark does not guarantee that an outing will proceed, that its description is accurate, or that anyone who has passed verification will behave responsibly. Users must make their own appropriate decisions about safety, travel and participation. Reporting through Spark is not an emergency service.
5. Hosting, joining and cancelling outings
Hosts must provide accurate information about location, time, activity, material participation restrictions, availability and any costs payable directly to a third party. Hosts must not misrepresent an affiliation with Spark or imply that Spark has approved or insured an event. Notify participants promptly if an outing is materially changed or cancelled.
Joining an outing creates no obligation for Spark to transport, supervise, insure or guarantee members. Participants must follow applicable law, venue rules and reasonable host instructions that do not conflict with these Terms. Spark may cancel or restrict a listing where necessary for safety, legal compliance or account administration. If a host closes their account, future outings may be cancelled and participants notified where feasible.
6. Price, commercial outings and payments
Spark's current core features are free. Spark does not presently process ticket payments or charge members for attending outings through the app. Independent venues and hosts may impose their own disclosed fees or conditions. Unless expressly stated otherwise, those arrangements are directly between the relevant parties; check costs, refund conditions and legitimacy before paying anyone.
Businesses and venues may create or promote legitimate commercial outings, subject to transparency, safety rules and any applicable additional agreement. We may introduce optional subscriptions, advertising, paid promotions or payment services in the future, but those products are not offered under these Terms at present. Before offering them, we will publish the applicable prices, billing, cancellation and refund terms and other required disclosures.
7. Community conduct and prohibited behaviour
Use Spark lawfully, respectfully and in accordance with the community standards in these Terms. In particular, do not engage in harassment, stalking, threats, discriminatory abuse, exploitation, sexual coercion, impersonation, fraud, scams, unsolicited commercial spam, illegal activities, misleading event listings, deliberate safety endangerment or unauthorised sharing of someone else's information. Do not upload unlawful material or infringe intellectual-property rights. You may not scrape the platform or use member information to contact, advertise to or profile others without an appropriate basis.
8. Member content and communications
You remain responsible for content you submit, including profile text, photos, outing descriptions and messages. You confirm you have the rights and permissions needed to share it. You grant Spark a limited, worldwide, non-exclusive licence to store, transmit, reproduce and display that content only as reasonably necessary to provide, secure, maintain and moderate the service, subject to the Privacy Policy. This does not transfer ownership of your content to Spark.
Messages and event information may be viewed by the participants authorised to access them. Other people may remember, retain or independently capture information you share; exercise care before publishing personal details. We may restrict or remove content where there is a reasonable lawful or safety-related basis to do so.
9. Safety, reports and moderation
You may report inappropriate members, communications or outings using Spark's reporting functions or by contacting sparkadminn@gmail.com. Spark may investigate available evidence and issue warnings, remove content, limit functionality, temporarily suspend accounts or permanently ban people for serious misconduct, fraud, substantial rule violations or serious safety risks. We may act quickly to prevent credible harm, followed by further review where appropriate.
A person may appeal a moderation or verification decision by email. A rejected verification applicant may receive a reason after signing in. A rejected or banned person may not evade restrictions by creating another account; a new submission or registration requires Spark's express approval where applicable. We aim to give an initial response to verification appeals within five business days. We may protect the identities of reporters and confidential investigation information where justified by law and safety.
10. Meeting people offline
Meeting others in person carries potential personal, travel, venue and activity risks. Choose public meeting locations where appropriate, tell a trusted person about plans, make independent travel arrangements and leave if you feel unsafe. Spark does not undertake continuous screening or supervision of members or venues. In an emergency, contact the appropriate emergency services rather than relying on Spark's reporting tools.
11. Personal information and verification documents
Our Privacy Policy explains which information we collect, how ID front/back images and verification-only selfies are handled, who may access them, how long records are ordinarily kept and how to exercise privacy rights. The selfie is not used as your public profile photo. Providing identification required for verification is a condition of accessing verified features. No clause in these Terms authorises unlimited retention or sale of verification documents.
12. Account closure and deletion requests
You may request closure using Profile → Settings → Delete account or by emailing sparkadminn@gmail.com. A request goes to an administrator for manual processing; pressing the request button does not automatically remove an account. We aim to fulfil straightforward valid and verified requests within 24 hours where practicable, subject to necessary checks, applicable legal obligations and justified exceptions. We will explain material delays when appropriate.
Upon closure we will remove or de-identify personal profile information and relevant uploaded documents in accordance with the Privacy Policy, and close the authentication account. Messages may remain visible in the chats of other participants; identifying links may be removed where feasible. Outings you host may be cancelled, and limited records may be retained for lawful dispute, safety or fraud-prevention purposes. You may make a specific privacy request if content still identifies you.
13. Intellectual property and the service
Spark's design, software, branding and other material belonging to NOA AFRICA (PTY) LTD or its licensors remain their property. Subject to these Terms, we give you a limited, revocable, non-transferable permission to use the available service for its intended personal or legitimate commercial outing purposes. You may not reverse engineer, interfere with, exploit vulnerabilities in or disrupt the service except to the extent protected by applicable law.
14. Availability, changes and ending access
Spark may be unavailable from time to time due to maintenance, outages, errors or third-party systems. We may change, pause or discontinue features for operational, security or lawful reasons. We will give appropriate notice of material changes where reasonably possible or legally required. Material revisions of these Terms will be published in the app, and renewed acceptance obtained when necessary. You may discontinue use and request closure if you do not agree to revised terms.
15. Liability and your statutory rights
Where permitted by law, we do not make guarantees about uninterrupted access, third-party venues, other members' behaviour or the occurrence or suitability of an independently hosted outing. To the extent allowed by applicable law, Spark is not responsible for losses resulting solely from the acts or omissions of independent hosts, venues or members. This clause does not exclude our liability for our own unlawful conduct or any rights, remedies, warranties or responsibilities that applicable law does not allow us to exclude, including mandatory consumer-protection rights.
Nothing in these Terms requires you to waive a right to lodge a lawful complaint or obtain relief from an appropriate regulator, tribunal or court.
16. Complaints, notices and governing law
For ordinary support, safety complaints, legal notices and account matters, contact sparkadminn@gmail.com, phone +27 69 929 1696, or write to 55 Carmen Place, Sandown, Sandton, South Africa. We aim to acknowledge ordinary support and safety reports within three business days, and aim to prioritise urgent safety reports for initial review within one business day, where reasonably possible. These are service targets, not an emergency-response guarantee.
These Terms are governed principally by the laws of the Republic of South Africa, subject to any mandatory rights that apply notwithstanding that choice. Parties should first attempt good-faith resolution of disputes, without preventing recourse to legally available forums.
17. General
If a provision is found unenforceable, the remainder continues to apply to the extent permitted by law. A failure to enforce a term immediately does not mean we permanently waive it. If the service introduces paid features, those features may have additional terms and consumer disclosures before any charge is made. The latest version of these Terms is available inside Spark.
Privacy Policy · Version 1.0 · Last updated 15 October 2026 · South Africa
1. Who we are and how to contact us
SPARK! (“Spark”, “we”, “us” and “our”) is a social-discovery and outing-planning service operated by NOA AFRICA (PTY) LTD, a South African private company with registration number 2026/794059/07, trading as SPARK!. NOA AFRICA (PTY) LTD is the responsible party for the processing described in this Privacy Policy under the Protection of Personal Information Act 4 of 2013 (“POPIA”).
Our legal-correspondence address is 55 Carmen Place, Sandown, Sandton, South Africa. You can contact us and our registered Information Officer at sparkadminn@gmail.com or +27 69 929 1696. Please use the email address for privacy rights, complaints, verification appeals and account-deletion requests. Our completed PAIA manual is available on request at that address.
2. Scope and eligibility
This Policy applies to people who visit, register for or use Spark, and to people who contact us about the service. Spark operates primarily in South Africa, initially Johannesburg. You must be 18 or older to use the platform. People visiting South Africa from other countries may register, but account verification currently accepts only a South African identity card or South African driving licence; someone without an accepted document may be unable to activate an account. We do not knowingly provide accounts to minors.
3. Information we collect
We process information relevant to the features you use:
- Registration and profile: email address, account identifier, display name, profile photograph if supplied, biography, interests, account settings and verification status.
- Identity verification: images of the front and back of an accepted ID document and a separate selfie submitted for verification; information visible in these images (which may include identification numbers and photographs); consent records; review outcomes; rejection reasons; and related appeals.
- Activities and communications: outings you host or seek to attend, outing descriptions, dates and venues, participation and join requests, chat messages, reports, blocks and notifications.
- Safety and administration: moderation reports, supporting information, restrictions, appeal correspondence, limited security and abuse-prevention records, and requests to access, correct or delete personal information.
- Technical information: sign-in and session records, browser and device information, approximate information such as IP address visible to service providers, error/security logs, and browser push-subscription details if you opt into push notifications.
- Information you send us: emails, support requests, complaints and information you choose to submit in those communications.
Do not send additional sensitive documents or other people's private details unless specifically needed for a legitimate request.
4. Why and on what grounds we process information
We use personal information to create and secure accounts; check identity and age eligibility; operate profiles, outings, join requests and chats; provide requested notifications and essential service communications; investigate reports, fraud and misconduct; handle appeals and data rights; maintain service security; and meet applicable legal obligations.
We process personal information where authorised by POPIA, as applicable to the purpose, including your consent, actions needed to provide the service you request, compliance with legal obligations, and our or another person's legitimate interests where allowed by law. The verification form seeks specific consent for collecting and manually reviewing ID images and the selfie. If you do not provide information essential to identity verification, you may be unable to activate an account. Withdrawal of consent may affect continued service and does not prevent retention that another lawful ground permits or requires.
5. Identity verification and selfies
Spark currently requires three separate verification images: ID front, ID back and a selfie. These materials are reviewed manually by the designated operator or another specifically authorised administrator. The verification selfie is not your public profile image, is not displayed to other members, and is not used for advertising. Spark does not currently use automated facial recognition or create an automated face-template database for verification.
Verification helps us assess the documents submitted; it is not a criminal-record check, background investigation or guarantee of a member's character or safety. A rejected applicant may see the reviewer's reason when signed in and may appeal by emailing sparkadminn@gmail.com. Any new registration or resubmission following rejection requires Spark's approval; banned users may not evade restrictions by opening replacement accounts.
6. Who can see your information
Approved members may see the profile details you choose to show and the outings you participate in or organise, to the extent needed for Spark's features. Hosts may receive your participation request and relevant profile details; accepted participants may see group messages and participant information.
Ordinary members do not receive access to your ID images, verification selfie, document numbers, internal report records or administrator notes. Authorised administrators may access only the information needed for verification, safety investigations and support. Your message content may be visible to the other participants in that conversation, so avoid posting information you do not want them to see.
7. Service providers and overseas processing
We use Supabase for authentication, application database services and file storage, and Netlify to host and deliver Spark's website. The main production Supabase project is hosted in West EU (Ireland). The website also loads certain fonts through Google Fonts and the Supabase JavaScript library through jsDelivr. Email confirmation and account-related mail may be delivered using the currently configured Supabase email infrastructure and relevant mail providers. Browser, operating-system and push-messaging providers may process information necessary to deliver notifications you enable.
These providers process information on our behalf or as independent service providers according to their roles. Infrastructure, support, network delivery and subprocessors may involve other countries. We seek appropriate security and contractual protection and assess international transfers under POPIA section 72. We cannot guarantee that all processing takes place exclusively in South Africa or Ireland.
Spark does not currently provide in-app payment processing or targeted advertising. Optional services or analytics tools considered for the future are not treated as operational providers in this Policy; we will update our notice when material new processing begins.
8. Notifications, technical storage and marketing
We may send essential account, security, verification and service emails. Depending on Spark's available features and your permissions, we may also display in-app notifications or send browser push notifications. You can change push permission through your browser or device settings; necessary transactional or security messages may still be sent.
Spark and its authentication services use necessary browser or device storage, such as session information, to keep you signed in and operate the site. Hosting and security providers may collect standard operational logs. We do not currently claim to operate a personalised advertising system. If we introduce direct marketing, non-essential tracking or advertising technology, we will provide the disclosures and choices required by applicable law; accepting these Terms does not grant blanket marketing consent.
9. Security and confidentiality
We use controls intended to reduce unauthorised access, including authenticated sessions, private storage for verification files, database access restrictions and staff-role protections for the Admin Dashboard. Authorised personnel must use personal information only for legitimate administrative duties. No online system is free from risk. We assess suspected security incidents and notify affected persons and the Information Regulator when required by POPIA or other applicable law.
10. How long we keep information
We apply the following standard retention schedule, subject to a longer or shorter period where required or permitted by law, an active appeal, a documented safety or fraud concern, or a legal hold. Our retention reviews and account deletions are administered manually; requesting deletion or reaching a target date does not automatically erase information from every service or backup.
| Information |
Standard period or approach |
| ID front, ID back and verification selfie for approved accounts |
Normally deleted during manual retention review within 30 days of approval, unless a documented reason justifies retention |
| Verification images for rejected accounts |
Normally retained for an appeal opportunity and deleted within 90 days of rejection, unless an appeal, rights request or lawful hold requires longer |
| Incomplete or abandoned verification uploads |
Reviewed for deletion after 14 days where no longer required |
| Minimal verification decision and consent evidence |
Normally up to 12 months after account closure, subject to decision-review and legal requirements |
| Active profile information |
Retained while the account is active; removed or de-identified following verified closure, subject to exceptions |
| Chat messages |
May remain visible in other participants' existing conversations; former-member profile links or identifiers are removed or de-identified where reasonably feasible |
| Future outings hosted by a departing member |
Normally cancelled or addressed with affected participants; unnecessary host identifiers are removed |
| Safety reports and moderation records |
Normally up to 24 months after case closure, with periodic review and justified extensions where required |
| Limited serious-ban or fraud-prevention records |
Normally up to 24 months, subject to proportionality and periodic review |
| Minimal deletion-request and fulfilment record |
Normally 12 months after completion |
| Provider backups |
Subject to the provider's actual backup and expiry arrangements; 30 days is our preferred planning target, not a guaranteed immediate purge |
POPIA may require us to retain records used to make decisions long enough to allow a reasonable opportunity to request access to them. Once we have no lawful basis to retain personal information, we take steps to delete, destroy or de-identify it securely. We periodically review this schedule and handling practices.
11. Account deletion and remaining messages
You can request account deletion using Profile → Settings → Delete account, or email sparkadminn@gmail.com. The app sends the request to our administrator; the request itself does not automatically delete the account. We verify the request, review lawful retention requirements and then manually delete or de-identify applicable profile data, relevant uploaded files and the Supabase authentication account. We aim to complete straightforward, valid requests within 24 hours of verification, where practicable; more complex requests or legal holds can take longer and will be explained when appropriate.
Existing messages may remain in the conversations of other participants, including content previously shared with them. We seek to remove unnecessary profile attribution, but messages containing information you wrote are not automatically anonymised merely because your account is closed. We consider specific deletion or correction requests on their facts and the applicable law. Future outings you host may be cancelled. Certain incident, fraud or legally required records may be retained in a limited form.
12. Your rights and choices
Subject to applicable law, you may ask us whether we process your personal information, request access to it, seek correction or deletion of inaccurate or unlawfully retained information, object to certain processing, withdraw consent where processing depends on it, and raise a complaint. We may ask for information reasonably necessary to verify your identity before acting on a sensitive request. Requests may be limited or refused on lawful grounds, which we will explain where appropriate.
Email sparkadminn@gmail.com with “Privacy request” in the subject line. We aim to acknowledge access and correction requests within five business days and respond within the time required by law. Do not email a full identity document unless we specifically arrange a secure method where it is necessary.
13. Complaints and our Information Officer
The Information Officer of NOA AFRICA (PTY) LTD is registered with the South African Information Regulator. Direct requests, objections, appeals and complaints to sparkadminn@gmail.com, telephone +27 69 929 1696, or our legal-correspondence address above. You may also complain to the Information Regulator (South Africa) at https://inforegulator.org.za/. Our PAIA manual explains requests for access to company records and is available on request.
14. Changes to this Policy
We may update this Policy as Spark's practices, suppliers, features or legal obligations change. The latest version will be available in the app. When required, we will give additional notice or seek fresh consent. The date at the top identifies this version; it does not assert that every future feature mentioned as a possibility is already available.
